Delaware Superior Court Judge Eric Davis on Wednesday cleared Fox News and its parent company, Fox Corp., of withholding evidence in the Dominion defamation case, and said he would consider further investigation and audits.
Attorneys for Dominion Voting Systems played recordings made by Fox News producer Abby Grossberg in 2020, according to a person present in court. Not turned over to Dominion’s attorneys during discovery.
Grossberg, a former producer for Fox hosts Maria Bartiromo and Tucker Carlson, is suing Fox News, claiming her confession was coerced. In a redacted filing Tuesday, Rudy said he recorded conversations with Giuliani, Sidney Powell and others.
The approval allows Dominion to run another form at Fox’s expense.

Fox News did not immediately respond to a request for comment on the sanction, but said in a statement Tuesday, “Rupert Murdoch is listed as the executive chairman of FOX News in our SEC filings since 2019, and this filing was referenced by Dominion’s own attorney. The filing.”
